1. Acceptance of Terms
Welcome to I Love Dog Pics ("we," "us," "our," or the "Site"). By accessing or using ilovedogpics.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
2. Eligibility
You must be at least 13 years of age to use this Site. By creating an account, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the Site.
We reserve the right to refuse service or terminate accounts at our sole discretion.
3. Photographer Accounts
To submit photos, you must create a photographer account. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
4. Photo Submissions & License Grant
4a. License You Grant Us
By submitting a photo to I Love Dog Pics, you grant us a non-exclusive, royalty-free, worldwide license to:
- Display the photo on the I Love Dog Pics website, including on breed gallery pages, the homepage, photographer profiles, and challenge/voting pages
- Create derivative versions including resized thumbnails, display-sized copies, and watermarked full-resolution versions bearing your photographer credit
- Share on social media including automatic posting to our official Facebook Page and other social media accounts we operate, always with photographer credit
- Promote the Site by using submitted photos in materials that promote the I Love Dog Pics project (not for unrelated commercial use)
- Enable user sharing through our "Download for Social" feature, which creates branded images with your photographer credit included
4b. What We Will NOT Do
- We will never sell or sublicense your photos to third parties
- We will never use your photos for unrelated commercial purposes (advertising products, stock photography, merchandise, etc.)
- We will never remove your photographer credit from shared or displayed images
4c. Your Representations
By submitting a photo, you represent and warrant that:
- You are the photographer or have proper rights and permission from the copyright holder to submit the photo
- The photo does not infringe on any third party's intellectual property, privacy, or publicity rights
- If identifiable people appear in the photo, you have obtained their consent (or their parent/guardian's consent for minors) for the photo to be displayed publicly and shared on social media
- The photo does not contain illegal, obscene, or otherwise objectionable content
4d. Removing Your Photos
You may remove your photos at any time through your photographer dashboard. Upon removal, we will make reasonable efforts to remove the photo from the Site. However, copies that have already been shared on social media or downloaded by users via the "Download for Social" feature cannot be recalled.
5. Automated Content Screening
We use artificial intelligence technology (provided by Anthropic) to screen submitted photos as part of our content review process. This automated screening:
- Checks that the photo contains a dog as the primary subject
- Screens for inappropriate or objectionable content
- Detects whether identifiable people are prominently visible in the photo
- Generates descriptive tags and alt-text metadata for accessibility
Photos flagged by our AI screening may be held for human review before approval. We reserve the right to reject any submission at our sole discretion, whether flagged by AI or reviewed manually.
Submitted images are sent to our AI screening provider (Anthropic) for analysis. Anthropic's use of this data is governed by their own privacy and data handling policies. Images are processed for screening purposes only and are not retained by the AI provider for training.
6. Acceptable Use
You agree not to:
- Submit photos you do not own or have rights to
- Submit content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Impersonate any person or entity
- Manipulate voting in photo challenges (including using multiple accounts or automated tools)
- Attempt to interfere with the Site's operation, security, or infrastructure
- Use the Site for any commercial purpose not expressly permitted
- Scrape, harvest, or collect data from the Site through automated means
- Upload malware, viruses, or other harmful code
7. Photo Challenges & Voting
We may host photo challenges with specific themes and voting periods. By entering a challenge:
- You agree to the Official Challenge Rules, which supplement these Terms
- Your submission is subject to the same license grant described in Section 4
- Winners are determined by community votes unless otherwise stated
- We reserve the right to disqualify entries that violate these Terms or the challenge rules
- Prizes (such as profile badges) have no cash value and are non-transferable
8. Intellectual Property
The I Love Dog Pics name, logo, website design, original content, and code are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our site design, branding, or original content without our written permission.
User-submitted photos remain the intellectual property of their respective photographers as described in Section 4.
9. Copyright Infringement (DMCA)
We respect the intellectual property rights of others. If you believe that content on our Site infringes your copyright, please see our DMCA Policy for instructions on filing a takedown notice.
We maintain a policy of terminating the accounts of users who are repeat copyright infringers.
10. Content Removal Requests
If you need to request the removal of content from the Site for reasons including but not limited to privacy concerns, see our Content Removal Request page.
11. Third-Party Links
The Site may contain links to third-party websites or services (such as photographer websites, social media profiles, and external resources). We are not responsible for the content, privacy practices, or availability of these external sites.
12. Disclaimer of Warranties
The Site is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Site will be available uninterrupted or error-free
- Content on the Site is accurate, complete, or current
- The Site is free of viruses or other harmful components
- AI-based content screening will be perfectly accurate
13. Limitation of Liability
To the fullest extent permitted by law, I Love Dog Pics and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:
- Your use of or inability to use the Site
- Any content posted or shared through the Site
- Unauthorized access to or alteration of your account or data
- Any third party's actions on the Site
Our total liability for any claim arising from these Terms or use of the Site shall not exceed $100 USD.
14. Indemnification
You agree to indemnify, defend, and hold harmless I Love Dog Pics and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Site
- Your submitted content, including any claims that your photos infringe on third-party rights
- Your violation of these Terms
- Your violation of any applicable law or regulation
15. Termination
We may suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. Upon termination:
- Your right to use the Site ceases immediately
- We may (but are not obligated to) remove your submitted content
- Sections 4 (license grant for previously submitted photos), 12-14, and 16 survive termination
16. Governing Law & Disputes
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or use of the Site shall be resolved in the courts of the state in which the Site operator resides, and you consent to the personal jurisdiction of such courts.
